Terms of Use and Sale

1. About these terms

These terms govern your use of the NurtureLift website and every purchase you make from NurtureLift, online, by phone or through our mobile showroom.

1.1 Who we are. NurtureLift is a brand operated by ThéraPlus, a registered business name of 2VC Inc., 3235 Av. de la Gare, Mascouche, Quebec J7K 3C1 (“NurtureLift”, “we”, “us”). Our warehouse is located at 6789 Boulevard Léger, Montréal, Quebec.

1.2 Acceptance. By using the website or placing an order, you agree to these terms. If you do not agree, please do not use the website or place an order.

1.3 Your statutory rights. Nothing in these terms limits or excludes any right you have under the Quebec Consumer Protection Act, the Civil Code of Québec, Ontario’s consumer protection legislation or any other law that cannot be waived. If a clause conflicts with such a law, the law prevails and the rest of these terms still apply.

1.4 Related policies. These terms incorporate our Privacy Policy, our Warranty Information and our 15-Day Enhanced Fit Exchange, available at nurturelift.ca. The order confirmation or sales contract you receive also forms part of your agreement with us.

1.5 Language. These terms are available in French and English. In Quebec, the French version is provided first; you may choose to be bound by the English version. Both versions have equal value.

2. Use of the website

You may use the website for personal, non-commercial purposes, such as browsing products, booking a showroom visit and placing orders.

2.1 Permitted use. You agree not to misuse the website, including by copying or scraping its content, interfering with its operation, attempting unauthorized access or submitting false information.

2.2 Accounts. If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Tell us promptly at support@nurturelift.ca if you believe your account has been compromised.

2.3 Intellectual property. The NurtureLift name, logo, collection names, photos, text and designs on the website belong to us or our licensors. You may not use them without our written permission.

2.4 Reviews and submissions. If you post a review, photo or comment, you confirm it is truthful and yours to share. You grant us a non-exclusive, royalty-free licence to display it on our website and marketing channels. We may remove content that is unlawful, offensive or unrelated to our products. We do not edit reviews to change their meaning.

2.5 Third-party links. Links to other websites are for convenience. Their own terms and privacy policies apply.

2.6 Availability. We aim to keep the website available and accurate, but it may be interrupted for maintenance or technical reasons.

3. Product information and medical device notice

NurtureLift power lift recliners are Class I medical devices sold in Canada under the rules of Health Canada.

3.1 Not medical advice. Information on our website, in our showroom and from our staff is general product information. It is not medical advice and does not replace an assessment by a physician, occupational therapist or other health professional. If you have a medical condition, reduced mobility or specific positioning needs, consult a health professional before choosing a chair.

3.2 Safe use and care. Read the user manual and safety instructions before use. Respect the maximum user weight, keep children and pets clear of the mechanism when it is in motion, and use the chair only for its intended purpose: seating, reclining and assisted standing. Follow our Care and Cleaning Guide: unplug the chair before cleaning, never clean the lift mechanism, motor or wiring yourself, and avoid alcohol or disinfectant wipes, bleach, solvents and steam on the performance fabric upholstery.

3.3 Product descriptions. We describe our products as accurately as we can. All NurtureLift chairs are upholstered in performance fabric. Colours may vary slightly from what you see on screen, and published dimensions are approximate.

3.4 Changes. We may update product specifications or discontinue models. If a change affects an order you have already placed, we will contact you before delivery and you may cancel for a full refund.

4. Orders, pricing and payment

Your order is accepted once we send you a written order confirmation or sales contract.

4.1 Contract information. Before you order, we disclose the product, total price, taxes, delivery fees, delivery date, and cancellation and warranty terms. You will receive a copy of the contract by email or on paper within 15 days of the sale, as required for distance contracts.

4.2 Prices. Prices are in Canadian dollars. Applicable taxes (GST/QST or HST) and delivery fees are shown separately before you confirm. We will not charge more than the advertised price. If a price is clearly wrong because of an obvious error, we will contact you before processing, and you may confirm at the correct price or cancel for a full refund.

4.3 No deposit. We do not require a deposit. Payment is due in full when you place your order.

4.4 Payment methods. We accept the credit cards authorized through our Shopify checkout, as shown at checkout. We do not offer financing.

4.5 Availability. Orders are subject to stock. If we cannot deliver the model you ordered, we will offer you a comparable model or a full refund, at your choice.

5. Delivery and White-Glove service

We deliver through our White-Glove Delivery service. Delivery fees and timelines depend on your address and are confirmed when you enter your delivery address, before you confirm your order.

5.1 What White-Glove includes. Delivery to the room of your choice with signature, unpacking, placement in the requested location where access allows, setup and a basic function check. Our team will also move the packaging out of the room for you and place it wherever you choose to keep it, such as a garage or storage area. Please note that we do not take the packaging away: you need to keep the original manufacturer packaging and shipping carton for 14 days, because it is required for an Enhanced Fit Exchange.

5.2 Scheduling. We will confirm a delivery date and time window with you. If we cannot deliver within 30 days of the date stated in your contract, you may cancel and receive a full refund.

5.3 Access. Please make sure there is safe access to the room, including doorways, stairs and parking. If the chair cannot be delivered safely because of access conditions we were not told about, we will contact you to discuss the options available.

5.4 Inspection. Please inspect the chair with our team at delivery and note any visible damage on the delivery form. If the chair is visibly damaged, incorrect or not the product you ordered, refuse the delivery and contact us within 24 hours. For Customer Pickup or home delivery without White-Glove service, contact us within 48 hours. This does not affect your warranty rights for defects found later.

5.5 Ownership and risk. The chair becomes yours, and you bear the risk of loss, once it is delivered and installed in your home.

6. Mobile showroom visits

Our mobile showroom brings chairs to your home so you can try them before buying, at no charge and with no obligation to purchase. We currently serve Montreal, Quebec City, Ottawa and Toronto.

6.1 Booking. You may book a visit online or by phone. We will confirm the date, time window and models we will bring.

6.2 During the visit. Our representative will help you try models and adjust settings. They will not provide a medical assessment. You may ask a family member, caregiver or health professional to be present.

6.3 Contracts signed at home: your 10-day right to cancel. If you sign a sales contract during a visit to your home, you may cancel it without cost or penalty within 10 days after receiving your copy of the contract. To cancel, return the chair if delivered or send us the cancellation form or any written notice at support@nurturelift.ca, or by mail to 3235 Av. de la Gare, Mascouche, Quebec J7K 3C1. We will refund all amounts paid within 15 days of receiving your notice. Longer cancellation periods apply if we did not meet all legal requirements for the contract.

7. 15-Day Enhanced Fit Exchange

NurtureLift offers a 15-Day Enhanced Fit Exchange. Its current conditions, eligibility and process are published on our Customer Care page. Please review them there before you order or request an exchange.

7.1 In outline. If you completed a qualifying NurtureLift Fit Consultation before purchase and the chair still does not fit as expected, contact us within 15 days of delivery. For the first approved Enhanced Fit Exchange a 20% restocking fee applies; NurtureLift covers standard pickup of the original chair and standard delivery of the replacement chair. The original White-Glove Delivery charge is not refundable once that delivery has been completed. The published conditions govern in case of any difference with this outline.

7.2 Fit Consultation. A qualifying Fit Consultation is a guided fit review with a NurtureLift advisor, completed before you order, through a Mobile Showroom visit or a phone or video fit call. It must have been completed within the 90 days before your order was placed. We issue you a Fit Consultation reference, which is also shown in your account.

7.3 Applicable version. The Enhanced Fit Exchange conditions published on the date of your purchase apply to your order. We will also send them to you with your order confirmation.

7.4 Relationship with your legal rights. The Enhanced Fit Exchange is an additional benefit. It does not replace or reduce your statutory rights to cancel (sections 6.3 and 8) or your warranty rights (section 9).

8. Cancellation and returns

You may cancel an order before delivery, and the law gives you specific cancellation rights in the situations below.

8.1 Before fulfillment. A stock-chair order may be cancelled with no cancellation fee before fulfillment or carrier scheduling begins.

8.2 Once shipped. Once the order has shipped it is no longer treated as a cancellation, and our Return Policy applies: a 20% restocking fee, customer-paid return pickup or return shipping, and any completed delivery charge, which is not refundable.

8.3 Distance contracts (online or by phone). You may cancel within 7 days after receiving your copy of the contract if we did not disclose the required information or send you the contract as required. You may also cancel if we do not deliver within 30 days of the promised date. We will refund you within 15 days of your cancellation.

8.4 Contracts signed at home. See section 6.3 for your 10-day right to cancel.

8.5 After delivery. Outside the rights above, the Enhanced Fit Exchange and the Standard Exchange described on our website, we do not accept returns of chairs that are not defective. This does not affect your warranty rights.

8.6 How to cancel. Email support@nurturelift.ca, call 1 (888) 886-5843 or write to 3235 Av. de la Gare, Mascouche, Quebec J7K 3C1, quoting your order number. A notice sent in writing is valid as of the date it is sent.

9. Warranties and after-sale service

Every NurtureLift chair is covered by the legal warranty and by the NurtureLift Warranty Information, version 1.0, effective for purchases made on or after September 25, 2026.

9.1 Legal warranty. Under Quebec law, your chair must be fit for the purpose for which it is ordinarily used and remain durable in normal use for a reasonable length of time, considering its price and conditions of use. This legal warranty applies in addition to our manufacturer warranty and cannot be excluded.

9.2 NurtureLift written warranty. In addition to the legal warranty, ThéraPlus provides a written warranty to the original purchaser of a new NurtureLift chair bought for personal, non-commercial use in Canada. It does not transfer on resale. The purchaser may buy the chair for one family member’s exclusive personal use. Coverage runs from the original date of sale on your dated proof of purchase, and the version in effect on that date applies.

Discounts apply to the suggested retail price of the approved replacement part or material, not the whole chair. For an approved claim during full coverage, we pay all costs needed to carry out the remedy, including parts, labour, inspection and transportation. Where this table states no position, the legal warranty applies.

9.3 What the written warranty does not cover. Ordinary wear, such as upholstery appearance changes, foam softening and suspension wear. Damage from misuse, accidents, pets, spills, cleaning products not approved for the performance fabric, exceeding the chair’s weight capacity, moves by someone other than NurtureLift, or unauthorized repairs. Chairs used commercially, rented to guests or tenants, or in shared institutional use. The complete list is in our Warranty Information.

9.4 Chargeable repairs for external causes. Diagnosis is always free, including the visit, even when the cause turns out to be external (for example, a power surge or a faulty outlet). A repair needed because of an external cause is offered as a chargeable repair at $80 per hour in 15-minute increments after a $160 minimum, or at a quoted flat rate. A $150 travel fee applies only when a separate visit is needed for the chargeable repair, in major cities in Quebec and Ontario, or as quoted. We never do chargeable work without your approval, given at the time or through an optional written pre-authorization up to a limit you set.

9.5 Claims. Contact Product Support at support@nurturelift.ca or 1 (888) 886-5843 with your dated proof of purchase, chair model and serial number, a description of the problem, and photos or video if possible. We aim to acknowledge your request within two business days.

9.6 Disagreements. If you disagree with a warranty decision, write to us and we will respond with reasons within 10 business days. You may then ask for a review by a manager not involved in the first decision, and for technical questions, an inspection by an independent technician paid by NurtureLift. Our Warranty Information describes this process in full.

10. Limitation of liability

We are responsible for our products and services as required by law, and we limit liability only where the law allows it.

10.1 What we do not limit. We do not limit our liability for bodily or moral injury, for our intentional or gross fault, or for any obligation under the legal warranty or consumer protection laws.

10.2 Website. To the extent permitted by law, we are not liable for indirect losses resulting from temporary unavailability of the website or from third-party websites linked from it.

10.3 Your responsibilities. You agree to use the chair according to the user manual and safety instructions. We are not responsible for damage caused by use contrary to those instructions, to the extent the law allows.

11. Privacy

We handle your personal information according to our Privacy Policy, in line with Quebec’s Act respecting the protection of personal information in the private sector and Canada’s PIPEDA.

11.1 What we collect. We collect the information needed to process orders, arrange showroom visits and deliveries, and provide warranty service, such as your name, contact details, address and order history.

11.2 Health information. We do not require health information to sell you a chair. If you choose to share information about your mobility or comfort needs to help us recommend a model, we use it only for that purpose and with your consent.

11.3 Automated tools. Our Find My Chair tool suggests models automatically from the answers you provide. Its results are suggestions only and do not confirm that a chair fits you; a Fit Consultation with a NurtureLift advisor is a separate step, described in section 7.2. You may ask to speak with a person at any time.

11.4 Your rights and contact. You may access or correct your personal information, or withdraw consent, by contacting our person in charge of the protection of personal information, Nick Andria, at support@nurturelift.ca.

12. Governing law, disputes, changes and contact

These terms are governed by the laws of Quebec and of Canada, without depriving you of the protection of the consumer laws of the province where you live.

12.1 Disputes. Please contact us first so we can try to resolve any issue; warranty disagreements follow the process in section 9.6. You may also contact the Office de la protection du consommateur (Quebec) or Consumer Protection Ontario. Nothing in these terms prevents you from bringing a claim before the courts of your province, including small claims court or a class action.

12.2 Changes to these terms. We may update these terms. The version in effect on the date of your order applies to that order. Changes do not affect contracts already concluded.
